imo the government shouldn’t have the right to execute. there are plenty of criminals that “deserve” death, but no justice system is perfect and therefore execution should never be an option. i believe pedophile rapists deserve death, but i also believe that the state should not have the right to kill. innocent people have died on death row, therefore it needs to be abolished

I don’t think we should prioritize executing people when our entire justice system as it currently exists desperately needs to be uprooted and recreated. That’s not the right answer. It’s because the justice system is broken that any crucial evidence presented in the court is often thrown out. The burden of proof is on the defendant and not the state. I am off for the death penalty, and we should, I don’t know, shoot them all, but then again there’s a risk of a third of them being innocent, and so commuting is the best option.

the burden of proof is defined in the constitution and it’s decided on by independent unbiased peers not the judge and if something is thrown out it MOST of the time is on the prosecution as they have to present evidence to the court by nature the defense essentially just needs to contest every piece of “evidence” they throw at them so the likelyhood of the DEFENSE having evidence thrown out is very low bc providing evidence is not the premises of the defenses job
