Should the first amendment to the Constitution be amended to prevent any first amendment challenges to making it illegal to take photos and videos of people in public places without consent? Should we play the long game to make this happen?
Without consent yes. It should be illegal to take photos of anyone in public without consent. If the picture was taken by family members or the pictures got consented by the legal guardian I don’t see why not

In my jurisdiction at least it’s only illegal under narrow circumstances. If you’re a convicted sex offender it’s illegal to take such photos of a child without parental consent.
