The fact that states allow it as a legal defense inherently means that in some cases it can be used as a valid justification to get off on charges. When I stated it was functionally legal, I never said that there aren’t associated costs (like being charged or going to court). Functional legality only requires the suspension of final consequence, not of costs entirely.

However, that‘s not an acceptable defense that a reasonable jury would accept. The issue is that the trans panic defense, while unreasonable, has precedent as being accepted by juries in multiple states. That’s what matters here. Not just the fact that it is a defense, but the fact that it is an *accepted* legal defense with precedent.

These people don’t understand that if something can be done that it is a danger to all who can be targeted by it. They are too naive and ignorant to know that anything weaponized against a specific group. Those in power have the ability to lie and claim you to be part of said group. Look at how they’ve handled sending people to a foreign prison for example. Many of whom had no criminal record. These people do not understand Martin Niemöller famous confessional from WW2.
