so before i knew anything about the law i always felt like men getting away w/ SA was a defense attorney problem. where i stand now, i ONCE AGAIN, unsurprisingly, realize DAs and cops doing 90% of the damage.

like THEY are the one’s responsible for a) charging these men with the crime and b) doing everything they can to prove their case in court. and they DON’T! they drop the charges. they don’t even charge people after reports. they are the ones slacking off on a THEIR jobs to zealously prove their case in court. defense attorney’s defend their client’s rights—but the DA’s job is to PROVE THE DAMN CASE. and they’re bias & incompetent. irks me so much.

yeah that’s exactly it. defense attorney is there to make sure the DA puts forward a strong case and that their clients rights were followed and proper evidence presented. the DA and especially the cops are the ones who are more interested in going after non-violent drug offenses than properly prosecuting rape

there’s a lot of other barriers with sexual assault cases, evidence collection can be difficult or inconclusive sometimes. the biggest one by far tho is you have a right to face your accuser in court so if you press charges you have to go to court and face your abuser and recount what they did to you in a court room which a lot of people do not want to do

they especially have a hard time appearing in court because our justice system is almost entirely focused on prosecution and punishment of a perpetrator as the only form of closure for victims. so while there are victim services they are often extremely lacking and it’s up to the victim to seek effective counseling and community support, however sexual abuse is often a matter of power and many victims are people who disproportionately are separated from the forms of support they would need

before the assault even happens and afterwards it’s very hard to then build those support systems while processing what just happened to them.
