If you actually read the article it talks about how she was likely in denial which is extremely common when going through a traumatic event. Plus women will fawn instead of freeze when it comes to threats. She could have still felt like there was a threat and reached out to the man to fawn.
Actually, changing your story when in deposition or testifying is pretty common for traumatic events. I work for a law office and I was a psych major in uni, so Ik about this kind of stuff. Also she never testified that she enjoyed it. In her original testimony she stated what happened and the da chose to not move forward with prosecution because there was no direct evidence of force used. It is still rape if she was high and/ or drunk. They also brought more men into it without her wanting it.
The DA then reopened the case because they recognized that the healing process is different for everyone. That is why her testimony or statement was not correctly stated. Hereās the DA statement. https://www.tompkinscountyny.gov/News-articles/District-Attorney-statement-regarding-Jane-Doe-v.-Cornell-University-et-al
Yes, she was sober and mentally stable right? So she swore to a government official and lied? Both parties are dumb and disgusting, the men should be jailed but so should she. She was having sex and having a good time and took MORE drug mid session. 3/7 dudes didnāt even touch her. Either way sheās in the wrong too
She could be in the wrong but then again the law is subject to changing for certain cases and there is precedent for trauma influencing statements. (And if she is in the wrong, the men can also sue her) Thatās why certain states now let you restate about your case years later. And now why you can wait like 50 years after csa to report it. Mental health affects a lot of your memories and how you act, so the law has changed a lot, especially in the past few years, to accommodate that.
Also if the DA believes she is in the wrong the DA will press charges. They are not a biased opinion, the DA acts in the best interest of the law. (Most times). Also one last thing, a statement under oath means at that time, that is what you truly believe what happened and it is to the best of your ability and knowledge. You also do that every time you renew your license or vote. Itās an oath, but humans are not infallible, we make mistakes on facts.
