Under current New York law, a person who is voluntarily intoxicated can still legally be considered capable of giving consent unless they are completely unconscious or physically helpless.

But… it’s not. Ignore the laws, MORALLY it is wrong if someone is not in their right state of mind. everyone knows (and if they don’t, they shouldn’t be drinking or doing substances) that substances alter decision making. And again, your first reaction is finding a way to blame the girl. That’s not a normal human reaction when something terrible happens 🤷🏼‍♀️🤷🏼‍♀️🤷🏼‍♀️

I completely agree, but unfortunately rape, just like every other crime, will never cease to exist. We are only in control of our own decisions, and we should minimize our own chances of being victimized.
