
I understand that trauma can cause memories to work in weird ways and that a lot of the time it takes time to fully understand what happened. But if a precedent is set that someone can come back years later and entirely rewrite a course of events from how she originally described them and we now just have to ignore her original testimony, doesn't this force us to legally consider any victims testimony after a traumatic event as something that cant be taken as fully trustworthy?
Or maybe they are dismissing it because it wasn’t until after the whole campus knew what happened she started to freak out and really changed her tune. She legit said she wanted to smoke with the guys again in a text afterwards. She didn’t even call it SA first. A news article did and after she saw that article it seemed like she might have found a way out of being humiliated on campus.
If you don’t know what it’s like to be a victim don’t speak on victims experiences like you were personally there for it. It’s extremely common to not realize what happened to you was wrong until someone points it out just like #3 said. It’s almost like you didn’t read my post at all and just decided to start saying bullshit
My point is that there are a lot of cases where SA and rape are being reported where the victims testimony is really the only piece of major evidence and if we have a precedent that their words can’t be a reliable piece of evidence because they’ve just been through trauma, doesn’t this hurt a lot of women’s cases?
That’s not how evidence works. You use all of the information you have available at any given time and draw the most reasonable conclusion. When new information is presented, however long it’s been since the first conclusion was drawn, you reassess the initial conclusion and draw a new one. That’s how science works. That’s how law works. There will always be a chance that the evidence you have at present is not accurate or doesn’t present the full story. That doesn’t mean you just throw it out
I literally told everyone in my family that I loved my older step sister and actively sought her out to spend time together from the ages of 4 until I was almost 11 and got the sex ed talk and realized what she had done to me for years. Sometimes you literally don’t know until you know better. And it’s not like it was “pleasurable”. Things she said to me live in my head still are “It’s supposed to hurt, that means you’re a big girl.” I hope this clears up some of your ignorance.
