Update: they only specify “serious mental illness” (which usually means schizophrenia, severe bipolar disorder, and personality disorders) and substance use disorders, but it seems like it could apply to any recognized condition a homeless person has as long as someone can argue that said condition prevents them from living independently. Technically “neurodivergence” includes all of the above but if you’re specifically asking about what the DSM-5 calls “neurodevelopmental disorders” then (1/2)
Only if you're homeless at the same time. Highly recommend reading the source itself to avoid misinformation. It's not about criminalizing disability, but making it easier to lock homeless people up ("you're on the streets and you have a mental disability? Well clearly you're dangerous, you need to be institutionalized")
