If they do end up banning gay marriage what will happen to couples who are already married? If the state requires people to get a divorce how will that even work?

It wouldn’t require divorce because there’d be no marriage to split up. I think the state would simply not recognize previous gay marriages as valid, retroactively denying them, which takes divorce off the table

This would be complicated because you would have to consider all the legal factors marriage has insurance, alimony, taxes, citizenship pathways. Like if they banned it and you’re paying your ex alimony since the marriage would not be legally recognized does that mean you still have to pay or could you even sue the county and get your money back

And there’s tons of other ways that not recognizing the marriage would screw the entire system. So what they will probably do is say after this date no new marriages will be recognized
