Doesn’t matter. Withholding the paycheck is straight up illegal. Even if someone steals something of equal value to the paycheck from the workplace, the employer must hand over the paycheck and go to the police over the stolen property. That’s how the law works.

businesses get their stuff back 1 of 2 ways: 1) [illegal] threatening employees, like by withholding their paycheck 2) small claims court (or a larger lawsuit if necessary) legally you CANNOT withhold a paycheck. the process would be paying them and then getting legal services involved to retrieve stolen property

i googled to check my own comment and all of this lines up with what i found. also for anyone wondering, this stuff comes at least partly from the Fair Labor Standards Act of 1938.
