In my high I find it necessary to overturn the 2010 Citizens United decision upon the grounds of it resting upon a doctrinal conflation of monetary expenditure with core political speech, a move that departs of longstanding campaign finance jurisprudence.Not only does it undermine the egalitarian premises of democratic governance, but by extending robust First Amendment protectants to unlimited independent political spending by corporations and other artificial entities, the decision exacerbates structural inequalities in political influence, distorts electoral competition, and weakens public confidence in democratic institutions.
Reinstating the government’s authority to impose reasonable limits on campaign expenditures would better align constitutional interpretation with the compelling state interest in preserving political equality, preventing corruption and its appearance, and safeguard the deliberative integrity of the electoral process within the constitutional framework overseen by the Supreme Court of the United States.
