Violation of the first. You’re free to get them fired, etc. but it’s not the government’s place to police speech. Even if it’s initially favorable to you, the same mechanisms would inevitably be used against you.

it shouldn’t be a crime BUT it should count as what’s typically described as “fighting words” that would disrupt the peace and incite someone to violence, which is a crime in itself in some states. Slurs aren’t crimes to say but oftentimes they are considered “fighting words” when directed toward someone in addition to menacing actions! Can’t say if any charges stick but an arrest is usually satisfying/degrading enough for most people involved lol.

Except it takes a lot for it to be considered harassment. It should only take a single instance for any reason to be considered a crime.

Good luck proving intent then. Same reason why libel and slander suits are impossible to win. And criminal court standards of evidence are even higher.
