If I take ur phone and smash it without ur permission, Id be charged w a crime cuz I violated ur rights/destroyed smth that was urs. If u voluntarily throw away ur own phone, that isn’t theft. The diff is who decided/ whether it was done against ur will

Not to mention- that double homicide law exists because the leading cause of death in pregnant women is murder, usually by their own husbands.

This doesn’t quite add up. If I kill you and your phone at the same time, that’s not a double homicide because your phone isn’t another life. Killing a pregnant woman is a double homicide because you ended two distinct lives without either of their consent. I get what you’re saying, but it doesn’t address the argument really.

But that’s exactly my point… double homicide applies when someone else kills the fetus against the pregnant woman’s will. If she chooses to end her pregnancy, there isn’t a second person violating her bodily autonomy. Same fetus, completely different circumstances: one is an unwanted act of violence, the other is a medical decision made by the pregnant person. The issue is consent, not about whether or not the fetus is a baby or not

The argument in the double homicide case is you are violating two separate entities’ right to consent, the mother’s and the fetus’s. Thus, you could then argue that in the case of abortion the mother is violating the fetus’s autonomy. The core distinction is what we consider life. Murder of a pregnant woman isn’t “Murder plus destruction of property”.
