I hate the guy but he is objectively correct, apart from the blatant propaganda. It was self defense. TN v Garder (1985) and Graham v Connor (1989) unfortunately set that precedent.

He could reasonably move out of the way ( which he did and continued shooting ) and no one else was in danger
