The constitution also says executive power can override in cases of securing national safety. Deporting a murderer who came illegally falls under that umbrella very well, especially if gang affiliated.

so fun fact: due process is included in “liberty and justice for all” and every resident of the states, citizen or not, is entitled to due process because y’know, that’s how you find out if someone is a citizen or not and they are detaining citizens.

I’m not the one arguing. The executive power portion is in regard to the deportation, which people think should get its own due process that I disagree with for convicted criminals.

Oh so close, immigration judges actually fall under the executive branch which the Supreme Court ruled unanimously recently, Trump can’t overturn.

I think of it as the president and his cabinet. If the supreme court recently ruled immigration judges into that for now, then sure

The Supreme Court didn’t rule that immigration judges magically fell under the executive branch. They fall under the executive branch because they are employees of the Executive Office of Immigration Review (EOIR), which falls under the umbrella of the US DOJ as a sub-agency.
