I think they’re trying to include stuff like Kalshi in their comment. Because that encompasses everything, not just sports

Kalshi is such a different beast because it technically sells event contracts. Futures (which work somewhat similarly) and derivatives have always been a thing (people trade gold futures, how much the Fed will raise rates, etc). This has been governed by the CFTC. Recent court rulings found that the federal laws regulating futures preempt state gambling laws, so it’s automatically legal in all 50 states. And Kalshi has (correctly) “bet” (lol) that this administration will look the other way…

…so they’re fine from a federal perspective. They’re getting sued by various states though, but so far haven’t faced any trouble afaik

Interesting. Yeah it kind of seems like a wild wild west right now. I already hate sports betting but kalshi is on another level
