I really think we have bigger fish to fry than that. Millions of carcinogens are pumped out industrially by millions of companies as well as our vehicles and sprayed onto plants. Banning smoking indoors is understandable but outside? There are much better ways to tackle these things than policing individual behavior, and I do not think that many individuals will even heed this law. If you wish to tackle smoking, target manufacturers and sellers.

They already banned nicotine patches, sued Philip Morris (albeit a tiny amount), and raised the price of cigarettes. This is just a piece of the puzzle. EU environmental regulations are already miles ahead of the US
