i mean that’s the legal obligation of the court, but if you believe they’ve never legislated from the bench, or don’t do so, you’re either stupid or willfully ignorant. the dissenting opinion on the tariff case centered on the difficulty posed in refunding the tariffs, rather than any issue of legal interpretation.
