It’s not, landlords or sellers cannot legally refuse tenants based on their ethnicity. They can try to refuse by making it look like it’s not based on ethnicity, but that will cause lawsuits they’ll usually lose. See Trump’s cases on this

They don’t rent out the land for housing though, it’s all owned by the private association, and is given to association members, and associations are allowed to discriminate

HOA’s are not allowed to discriminate based on race. The only groups that can do this are religious ones bc they have an exemption. Any HOA that does that is liable to be sued for violating the FHA

Not an HOA, just a private association. Think like the Freemasons, they legally discriminate on gender all the time. Private associations are allowed to discriminate.

If you’re talking about something like a retreat, or a festival, then yes you’re right. Fair Housing Act applies only to places where people live

Applies to all rent. For selling one you own there’s an exemption. You have to not use any broker or agent and not own more than 3 of them and it doesn’t apply

So if an association owned them and only allowed members of the association to use them, they are under no legal obligation to prevent discrimination

When you say use, do you mean as like part of a getaway or a retreat? Or for ppl to live permanently. If it’s for permanent living, I believe it’s illegal unless there’s some loophole, in which case it should be
