I agree they are both civil violations, but there is a massive difference. Each one has different penalties. The penalty for a first time dui is not the same as turning without a turn signal just like crossing the border is not the same as jaywalking.

Being undocumented doesn’t mean you illegally entered the country either. Many of them came in legally and the system has failed them so they overstayed their visa

“Legally wrong” doesn’t matter nearly as much as morally wrong. The law is not immutable, it is designed to be altered and expanded upon to address systemic errors and improve upon itself over time. Key example of one of those systemic issues: punishing people for a victimless civil offense that’s on the same level as running a red light by throwing them In foreign prisons without due process.

Correct. The law of un documentation being a civil offense reflects how society would deem it minimal, yet the punishment being doled out for it is incredibly severe. In case you haven’t pieced it together, that is the issue here. The punishment doesn’t match the severity of the crime.
