Trigger warning // rape the judges acknowledged that his conviction is synonymous with rape in common language the only reason he was not explicitly charged with rape is because New York state’s rape law is very explicit in requiring non consensual penile penetration; meanwhile rape is understood as penetration of any kind without consent. he is a rapist, no matter what; he just escaped the explicit conviction of rape due to an obscure technicality.
