This was 8-1 so usually I’d say there’s a decent reason for it, but KBJ brings up a good point here. Would it be illegal to require therapists to follow the standard of care?
This is just for talk therapy though. No physical or medicinal interventions

hmm HIPAA would be unconstitutional then, so that can’t be it. There’s probably some restrictions when you’re a professional bound by a code of ethics

So it seems like the majority looked at this from a speech POV, and said that states can still regulate conduct. HIPAA, by comparison, is conduct. KBJ says this is all conduct too, even if it’s just talk therapy
